The agency alleged that Balina had pooled investor funds using Telegram and distributed SPRK tokens without proper registration. In May 2024, a court agreed with the SEC’s assessment that SPRK qualified as a security.But now, with a markedly more crypto-friendly administration in power, the agency appears to be walking back its aggressive stance. The stipulation to dismiss also mentioned conserving court resources and came with a clear note: neither side would bear costs or fees.This dismissal joins a growing list of scrapped enforcement actions in recent weeks.
